Terms of Service

These Terms of Service ("Terms") govern your access to and use of DICOMAnon.com and related software applications (collectively, the "Service"). The Service is operated by Red Ion LLC, located in Birmingham, Alabama, United States ("Red Ion," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of the Service

DICOMAnon.com is a software application designed to anonymize and process medical imaging and document files for research, clinical trials, and other non-clinical purposes.

The Service consists of:

  • A web application implemented using Blazor WebAssembly that runs locally in the user's web browser
  • Optional locally installed executable components that facilitate local network communication with DICOM systems

File processing occurs locally on the user's system. The Service does not receive or store user files.

2. Eligibility and Accounts

You must be legally capable of entering into a binding agreement to use the Service.

Access to certain features requires authentication through a third-party identity provider and may require purchase of a license. You are responsible for maintaining control over access to your licensed account and devices.

3. Licensing and Authorized Use

Subject to these Terms and payment of applicable fees, Red Ion grants you a limited, non-exclusive, non-transferable, revocable license to use the Service solely for its intended purposes.

You may:

  • Use the Service on authorized devices associated with your license
  • Manage licensed devices through the application interface
  • Process files locally using the provided user interfaces

You may not:

  • Exceed the number of devices permitted by your license
  • Share licenses between unrelated individuals or entities
  • Use the Service in a manner that violates applicable laws or regulations

4. Device Registration and License Enforcement

For locally installed executable components, the Service uses a machine identifier to associate software instances with a valid license.

You acknowledge and agree that:

  • License enforcement mechanisms are necessary to protect the Service
  • Device limits are enforced based on license terms
  • You are responsible for managing authorized devices through the provided controls

Red Ion reserves the right to suspend or revoke licenses that are used in violation of these Terms.

5. Restrictions on Use

Except as expressly permitted by these Terms, you agree not to:

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service or any component thereof
  • Modify, alter, or create derivative works of the Service
  • Circumvent or attempt to circumvent licensing, authentication, or security mechanisms
  • Use the Service outside of its intended execution environment, including attempting to extract, repackage, or run WebAssembly components independently of the provided application framework
  • Use the Service for clinical diagnosis, treatment planning, or patient care
  • Use the Service to process data in violation of institutional policies or applicable laws

These restrictions are standard conditions of licensed software and apply except to the extent prohibited by applicable law.

6. Intended Use and Medical Disclaimer

The Service is not intended for clinical use and is not a medical device.

The Service is provided as a user-interface tool for anonymization and file processing in non-clinical contexts such as research and clinical trial preparation. You are solely responsible for determining whether use of the Service is appropriate for your intended purpose.

7. Payments and Fees

Certain features of the Service require payment of fees. Payments are processed through a third-party payment processor.

Red Ion does not process or store payment card information. Fees are non-refundable except as required by law or expressly stated at the time of purchase.

8. Intellectual Property

The Service, including all software, interfaces, designs, and documentation, is the intellectual property of Red Ion LLC and its licensors.

These Terms do not grant you ownership rights in the Service, only a limited right to use it in accordance with these Terms.

9. Availability and Changes

We may modify, suspend, or discontinue the Service or any part of it at any time. We may also update these Terms from time to time.

Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or suitable for any specific use.

11. Limitation of Liability

To the maximum extent permitted by law, Red Ion LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

Our total liability for any claim arising under these Terms shall not exceed the amount paid by you for the Service during the twelve (12) months preceding the claim.

12. Termination

We may suspend or terminate your access to the Service if you violate these Terms.

Upon termination, your license to use the Service will immediately cease.

13. Governing Law

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles.
